Home: Who We Are

Temporary protection in the event of a mass influx of displaced persons :
 

Temporary protection is the procedure guaranteeing immediate and temporary protection to persons forced to move and leave their country due to war. This type of protection is compatible with the right to seek asylum and is regulated by EU Directive 2001/55/EC.

 

What rights do I have under temporary protection?

  • Residence and work permit (self-employed or employed) of 1 year, extendable to 3.

  • Access to medical care.

  • Access to adequate accommodation and social assistance within the reception system.

  • Access to education for children under 18 years of age.

Who can apply for temporary protection?

  • Ukrainian nationals and their family members who left Ukraine on or after 24.02.2022.

  • Ukrainian nationals and their family members residing in Spain before 24.02.2022 who, as a result of the war, cannot return to Ukraine.

  • Refugees and beneficiaries of international protection in Ukraine and their family members who left Ukraine on or after 24.02.2022.

  • Third-country nationals or stateless persons who were legally residing in Ukraine on the basis of a valid legal residence permit (whether permanent or of another kind, e.g. student) under Ukrainian law and cannot safely return to their country of origin.

  • Ukrainian nationals who were in an irregular situation in Spain before 24.02.2022 and who, as a result of the war, cannot return to Ukraine.

 

“Family members" means (except for the case of irregular status): (i) spouse or unmarried partner; (ii) unmarried minor children or children of their spouse; (iii) other close relatives dependent on them.


How and where can I apply for temporary protection?

1. By personal appearance before the National Police at:

  • Reception centers of the Ministry of Inclusion, Social Security and Migration: Pozuelo de Alarcón (Madrid), Fira de Barcelona (Barcelona), Ciudad de la Luz (Alicante).

  • Police stations designated for this purpose (see the list by cities HERE).

2. Bring all the documentation you have that proves your Ukrainian nationality or legal residence in Ukraine. The application for minors shall be made by the accompanying adult.
3. On the same day as the application, a receipt will be issued certifying the application for temporary protection authorizing you to stay in Spain and access social benefits.

4. Within 24 hours of the application, the Spanish Ministry of the Interior will issue a decision on the application which will be notified by electronic means, post or personal appearance.



International protection in Spain :

International protection is the help offered to a person who is outside their country and cannot return because their life is in danger there. The forced displacement of people in need of international protection is due to various reasons such as persecution (for political or other reasons), wars and/or violation of human rights.
 
In Spain, under the Geneva Convention on Refugees and European and national legislation, international protection includes both the right to asylum, which is granted to refugees, and subsidiary protection, which is granted to foreigners who are not refugees but are in certain situations of risk and cannot return to their country of origin.
